Health Insurance After Divorce in Wyoming

Health Insurance After Divorce in Wyoming

If you were covered under your spouse's employer health plan, your coverage ends when the divorce is finalized. The plan treats divorce as a qualifying event that terminates dependent eligibility — and the clock starts immediately.

You have three main options, each with its own deadlines. Miss the window, and you could face months without coverage.

Option 1: Federal COBRA (Employers With 20+ Employees)

COBRA lets you continue the exact same group health coverage you had during the marriage — same plan, same network, same benefits. The catch is cost: you pay the full premium plus a 2% administrative fee, with no employer subsidy.

Key details:

  • Election deadline: 60 days from the date you receive the COBRA election notice (or 60 days from coverage loss, whichever is later)
  • Coverage duration: Up to 36 months for divorce-related qualifying events
  • Cost: The full unsubsidized premium. For individual coverage, the national average is around $584/month, though your plan may be higher or lower
  • Retroactive coverage: If you elect within 60 days, coverage is retroactive to the date it was lost. You'll owe back premiums for any gap months

COBRA works well as a bridge — it keeps your current doctors and prescriptions while you find a long-term plan. But the cost often makes it unsustainable beyond a few months.

Option 2: Wyoming Mini-COBRA (Employers With 2–19 Employees)

If your ex-spouse works for a smaller employer that doesn't meet the 20-employee threshold for federal COBRA, Wyoming's mini-COBRA law under Wyo. Stat. § 26-19-113 provides a similar continuation right — but with a shorter window.

Key details:

  • Election deadline: 31 days from coverage loss
  • Coverage duration: Up to 12 months
  • Cost: Full premium plus up to a 2% administrative fee
  • Applies to: Group health plans issued by employers with 2–19 employees in Wyoming

The 31-day window is tighter than federal COBRA's 60 days, so act fast. Contact the plan administrator or the employer's HR department immediately after your decree is entered.

Option 3: ACA Marketplace (HealthCare.gov)

Divorce triggers a 60-day Special Enrollment Period on the ACA marketplace, allowing you to enroll outside the normal open enrollment window. Wyoming uses the federal marketplace at HealthCare.gov.

Key details:

  • Enrollment deadline: 60 days from the date of your divorce
  • Subsidies: If your post-divorce household income qualifies, you may be eligible for premium tax credits that substantially reduce your monthly cost
  • Coverage start: Typically the first of the month following plan selection
  • Plans available: Bronze, Silver, Gold, and Platinum tiers with varying deductibles and copays

For many newly divorced people, an ACA marketplace plan ends up being more affordable than COBRA — especially with premium tax credits. If your income dropped significantly because of the divorce, run the numbers on HealthCare.gov before defaulting to COBRA.

Option 4: Employer Coverage (If You Work)

If you have access to your own employer's health plan but weren't enrolled because you were covered under your spouse's plan, your divorce is a qualifying life event that triggers a special enrollment period with your own employer. Contact your HR department — most plans give you 30 days from the qualifying event to enroll.

This is often the most cost-effective option since your employer subsidizes part of the premium.

Medicaid

If your post-divorce income falls below 138% of the federal poverty level, you may qualify for Wyoming Medicaid. Wyoming expanded Medicaid eligibility effective in 2024, so this is worth checking even if you weren't previously eligible. Apply through the Wyoming Department of Health.

The Timeline That Matters

Coverage Option Enrollment Deadline Maximum Duration
Federal COBRA 60 days from notice/loss 36 months
Wyoming mini-COBRA 31 days from loss 12 months
ACA Marketplace 60 days from divorce Indefinite (renews annually)
Employer plan (your own) ~30 days from qualifying event Indefinite
Medicaid No deadline Indefinite (income-based)

The danger zone is the gap between your divorce being finalized and your new coverage starting. If you need medical care during that gap, you're uninsured — and Wyoming's uninsured rate already sits above the national average.

Start researching options before your decree is entered. Know which path you'll take so you can act immediately on the day it's finalized.
