Financial Non-Disclosure in a Wales Divorce

Full Disclosure Is a Legal Obligation, Not a Courtesy

In every divorce financial settlement in England and Wales, both spouses have a duty to provide "full, frank, and honest disclosure" of their financial position. This is not optional guidance — it is a legal requirement enforced by the Family Court, and the consequences for breach are severe.

Whether you are completing Form E for contested proceedings or Form D81 for a consent order, you must disclose everything: bank accounts, savings, investments, pensions, property, business interests, debts, and any assets held by third parties on your behalf. Omitting an asset — even one you genuinely believe is non-matrimonial — can unravel a sealed financial order years after the divorce was finalised.

How Hidden Assets Are Discovered

Form E questionnaires. After both parties exchange their Form E financial statements, each side can submit written questions challenging the other's disclosure. These questions form part of the disclosure process and require a response. A spouse who cannot explain gaps between declared income and lifestyle spending raises immediate red flags.

Bank statement analysis. Courts routinely request 12 months of bank statements for every account. A forensic accountant — or even a careful litigant in person — can identify patterns: regular cash withdrawals with no stated purpose, transfers to unfamiliar accounts, payments to third parties who might be holding funds.

Third-party disclosure orders. If suspicion is high enough, a judge can order banks, accountants, or employers to produce records directly. Under Part 25 of the Family Procedure Rules, the court can also appoint a Single Joint Expert to investigate specific financial questions.

Adverse inference. When a spouse refuses to provide documents or gives evasive answers, the court can draw an "adverse inference" — effectively assuming the worst. If a spouse claims to have no savings but evidence suggests otherwise, the judge may calculate the division based on an estimated higher figure.

Land Registry and Companies House searches. Property ownership and company directorships are public records. Land Registry can help check registered property ownership, while Companies House can help identify directorships and filed information for limited companies.

What Happens When Non-Disclosure Is Proven

The consent order can be set aside. Under the Matrimonial Causes Act 1973, a Financial Consent Order can be reopened if it was based on incomplete or misleading disclosure. In Sharland v Sharland [2015], the Supreme Court confirmed that a consent order obtained by material non-disclosure is vitiated by fraud and can be set aside entirely — even years after it was sealed.

Costs orders. The court can order the non-disclosing spouse to pay the other party's legal costs for the proceedings needed to uncover the concealment. In a jurisdiction where costs orders are discretionary and unusual, this is a significant judicial sanction.

A worse outcome. Judges who discover non-disclosure tend to view the offending spouse unfavourably when exercising their discretion on asset division. The practical result is often a less favourable split than honest disclosure would have produced.

How to Protect Yourself

Keep your own records. During the marriage, maintain awareness of joint accounts, investments, and property holdings. Note account numbers, approximate balances, and any unusual transactions. If you suspect concealment after separation, these contemporaneous notes are more useful than trying to reconstruct a financial history from memory.

Request pension CETVs early. Each spouse's pension provider will issue a Cash Equivalent Transfer Value on request using Form P. You can request your own CETV directly — you do not need your spouse's cooperation for that.

Do not accept incomplete disclosure. If your spouse's Form D81 or Form E has gaps, missing documents, or round-number estimates, raise it formally. For consent orders, a judge reviewing Form D81 may reject the application if the financial picture looks incomplete. For contested proceedings, use the questionnaire stage to press for specifics.

Consider professional help for complex situations. A forensic accountant can analyse business accounts, trace funds through multiple accounts, and quantify lifestyle inconsistencies. For modest-asset cases, the cost of a forensic investigation may not be justified, but for high-value concealment the expense typically pays for itself.
