Family Court Costs Northern Ireland: Fees, Solicitor Rates, and Fee Exemptions

Court Filing Fees

The Northern Ireland Courts and Tribunals Service charges fixed fees for children's applications. The exact amount depends on which court tier handles your case:

Family Proceedings Court (Magistrates' Court): £71 application fee + £19 summons fee + £4 per document served. Most children-only cases (Form C1 applications for Residence, Contact, Specific Issue, or Prohibited Steps Orders) start here. Total initial outlay: approximately £94-£100.

Family Care Centre (County Court): £107 application fee. Cases that are linked to divorce proceedings or that involve greater complexity may be filed here or transferred up from the Magistrates' Court.

High Court (Family Division): £142 application fee. Reserved for the most serious matters — international abduction, wardship, and cases where urgent injunctive relief is needed.

For divorce proceedings that include children's arrangements via Form M4, the County Court divorce package costs £856 (core fee covering the petition, certificate of readiness, and decree absolute). The High Court package is £937.

Solicitor Fees

Private family law solicitors in Northern Ireland typically charge:

  • Hourly rates: £150-£282+ VAT
  • Initial retainer: £500+ on account before work begins
  • Uncontested case (agreement reached through solicitor negotiation): £1,500-£3,000 total
  • Contested case (proceeds to hearings): £5,000-£15,000+
  • Heavily contested case (multiple hearings, expert reports, appeals): £10,000-£30,000+

These figures don't include barrister fees if a barrister is instructed for court appearances.

Barrister Fees

If your case reaches a contested hearing, your solicitor may instruct a barrister (also called counsel) to present your case in court. Barrister fees for a single hearing day typically range from £1,000-£5,000+, depending on the complexity of the case and the seniority of the barrister.

For a directions hearing or short review hearing, expect £300-£500 for the barrister's attendance, plus your solicitor's preparation time.

The Fee Exemption (Form ER1)

If you can't afford the court filing fees, you can apply for a fee exemption using Form ER1. You're automatically eligible if you receive any of these benefits:

  • Income Support
  • Income-based Jobseeker's Allowance
  • Income-related Employment and Support Allowance
  • Universal Credit (with some conditions)
  • Guarantee element of Pension Credit

If you're not on qualifying benefits but have a low disposable income, the court can still grant a partial or full exemption based on a means test.

A separate Form ER1 must be filed for each individual court fee. If your case involves a filing fee and a summons fee, that's two ER1 applications. The form is available from the NICTS website or your local court office, and the decision is usually made within a few weeks.

Legal Aid

Legal aid for private family law cases in Northern Ireland is extremely limited. It's generally only available for:

  • Cases involving domestic violence or abuse
  • Cases where children are at risk of harm
  • Cases involving child abduction (domestic or international)
  • Certain emergency applications (ex parte orders)

The Legal Services Agency Northern Ireland administers legal aid. If you qualify, your solicitor's fees and court costs are covered, though you may be required to make a contribution depending on your income. Many parents fall into the gap — too much income to qualify for legal aid, too little to afford private representation.

The Real Cost of Self-Representation

Faced with solicitor fees that can reach five figures, many parents represent themselves as Litigants in Person. The court filing fees alone (£71-£142 plus service costs) are manageable for most people, and the fee exemption catches those who genuinely can't afford them.

The hidden cost of self-representation isn't financial — it's the time and stress of navigating unfamiliar procedures, completing court forms correctly, drafting written evidence, and presenting your case in a courtroom. Mistakes cause delays, and each delay extends the uncertainty for your child.

A middle ground: some parents instruct a solicitor for specific tasks only — reviewing their Form C1 before filing, preparing their written statement, or providing advice before a hearing — rather than retaining them for the full case. This "unbundled" approach typically costs a few hundred pounds per task.

Keeping Costs Down

Mediation first. Family Mediation Northern Ireland offers pre-court mediation that's often free under Department of Health funding. If you can agree on terms through mediation and formalise them as a Consent Order, the total cost is a fraction of contested proceedings.

Prepare thoroughly. The better prepared your paperwork, the fewer solicitor hours you'll burn if you do instruct one. A clear chronology, organised evidence, and a specific parenting plan proposal reduces the time your solicitor spends getting up to speed.

Don't litigate the relationship. The court doesn't care who was the better partner. Every hearing spent relitigating the marriage is money spent on something the judge will disregard. Focus exclusively on the children's welfare.
