Emergency Custody Orders in Rhode Island
When a child is in immediate danger — abuse, neglect, abduction risk, or sudden unilateral relocation — waiting for a regular court hearing isn't an option. Rhode Island provides an emergency pathway that can produce a temporary custody order the same day you file.
What Qualifies as an Emergency
Emergency orders aren't for garden-variety custody disputes. The court requires evidence of immediate and irreparable harm to the child. Situations that typically qualify:
- Physical or sexual abuse
- Severe neglect endangering the child's health or safety
- Credible threat of abduction or removal from the state
- Active substance abuse creating an unsafe environment
- Domestic violence putting the child at risk
A disagreement over parenting time, scheduling conflicts, or disputes about extracurriculars will not meet the threshold.
The Filing Requirements
To seek emergency relief, you must file an Ex Parte Motion for Emergency Temporary Custody with the Family Court. "Ex parte" means the court can act without advance notice to the other parent. Your filing must include:
- A verified complaint initiating the custody action (or referencing an existing case)
- A detailed supporting affidavit specifying facts that demonstrate immediate and irreparable harm — not conclusions, but concrete facts with dates, locations, and specifics
- A completed Form DR-6 (Rhode Island's mandatory financial disclosure)
- Supporting evidence such as police reports, DCYF records, medical documentation, or photographs
Under R.I. Gen. Laws § 15-5-19, a judge or magistrate reviews the paperwork the same day it's filed. If the court finds sufficient evidence of immediate risk, the judge signs a temporary emergency order without prior notice to the other parent.
The Return-Day Hearing
An emergency order is highly temporary. The court must schedule a "Return Day" hearing within 14 to 21 days. At this hearing, the other parent has the opportunity to appear, present evidence, and contest the emergency order.
The judge then decides whether to dissolve the emergency order, modify its terms, or extend it as a pendente lite (temporary) order while the broader case proceeds. You should be prepared to present the same evidence in person, along with any additional documentation gathered since the emergency filing.

After the Emergency
If the emergency order is sustained, the case proceeds through normal Family Court channels — mediation for appropriate cases, or the contested track for ongoing disputes. The emergency order remains in effect until replaced by a permanent order.
