DIY Divorce Wales: Filing Without a Solicitor

The Divorce Itself Is Straightforward — the Financial Split Is Not

Filing for divorce in Wales is now a largely administrative process. Since the Divorce, Dissolution and Separation Act 2020 introduced no-fault divorce, you no longer need to prove fault or wait for years of separation. You submit a statement that the marriage has broken down irretrievably, wait 20 weeks for the reflection period, apply for a Conditional Order, then wait another six weeks and one day before applying for the Final Order. The entire process can be done online through the MyHMCTS portal, and the court fee is £628 (effective 13 July 2026).

Where DIY divorce gets genuinely difficult is the financial settlement. The legal divorce and the financial split are two separate processes. A Final Order dissolves the marriage but does nothing to divide assets, settle pension claims, or allocate debts. Without a court-approved Financial Consent Order, either spouse can make a financial claim against the other years or even decades later.

What You Can Realistically Do Yourself

The divorce application. The MyHMCTS online portal walks you through Form D8 step by step. You can file as a sole applicant or jointly with your spouse. Joint applications avoid the formal service and acknowledgement stage, which saves time.

Financial disclosure. Both spouses need to lay out their complete financial position — assets, debts, income, pensions, and expenditure. For an agreed settlement, this goes on Form D81 (Statement of Information for a Consent Order). For contested proceedings, the far more detailed Form E is required instead.

Drafting a consent order. If you and your spouse agree on how to divide everything, you can draft a consent order yourselves. The court charges £62 (effective 13 July 2026) to process it. A judge reviews the order on paper to check it is fair — they can reject it and request amendments, but most straightforward agreed splits are approved without a hearing.

Help with Fees. If your gross monthly income is at or below £1,420 for a single applicant (with £265 allowances for a partner and each dependent child), the EX160 application may provide full remission; higher qualifying incomes may receive partial remission. Universal Credit recipients with earned income under £6,000 per year may qualify for full remission if they also meet the scheme's capital conditions.

Where DIY Reaches Its Limits

Pensions above £100,000. The Cash Equivalent Transfer Value that pension providers issue routinely undervalues defined benefit schemes — NHS, Teachers', and Civil Service pensions provide guaranteed, inflation-linked income for life that is far more expensive to replace on the open market than the CETV figure suggests. The Pensions Advisory Group recommends instructing a Pension on Divorce Expert when combined CETVs cross £100,000.

Business interests. Valuing a limited company, partnership share, or sole trader business for divorce requires forensic accountancy. In a contested case where an expert valuation is needed, a court may appoint a Single Joint Expert, and the valuation process involves three years of accounts, adjusted earnings calculations, and asset-by-asset analysis that goes beyond what a DIY approach can handle.

Non-disclosure or hidden assets. If your spouse is not cooperating with financial disclosure — or you suspect they are hiding assets — you need a solicitor to file Form A, start formal financial remedy proceedings, and use the court's powers to force disclosure.

Domestic abuse. Power imbalances make direct negotiation unsafe. Legal aid is still available for domestic abuse cases, and the MIAM exemption means you can proceed to court without attending mediation first.
