The cost of divorce in Tasmania depends on whether you file jointly or alone, whether you qualify for a fee reduction, and whether your spouse cooperates with service. Here is every cost you need to budget for, with the current 1 July 2026 fee schedule.
The Filing Fee
The FCFCOA filing fee is the single largest cost:
- Standard fee: A$1,170
- Reduced fee: A$390
The reduced fee applies if you hold an eligible government concession card — Health Care Card, Pensioner Concession Card, or Commonwealth Seniors Health Card. It also applies if you are receiving Legal Aid, are under 18, or are currently incarcerated.
For joint applications, both parties must independently qualify for the reduction. If one of you holds a concession card and the other does not, the full A$1,170 applies. For sole applications, only the applicant needs to qualify.
Hardship reduction. If you do not hold a concession card but paying A$1,170 would cause severe financial hardship, you can apply for a fee reduction to A$390. The court assesses this using structured income, asset, and expense tests.
The filing fee is non-refundable. If the registrar rejects your application for a procedural error, you lose the fee and must pay again to refile.
Marriage Certificate Replacement
If you cannot locate your official marriage certificate, you need a replacement from the Tasmanian Registry of Births, Deaths and Marriages. The current fee is A$68.31 including registered post.
For marriages that took place overseas, you may need a NAATI-certified translation of the certificate plus a translation affidavit. Translation costs vary but typically run A$100–A$200 per document.
Process Server Costs (Sole Applications Only)
If you are filing a sole application, you must serve the papers on your spouse through an independent third party. You have two options:
- Free option: Ask a friend, family member, or colleague over 18 to hand-deliver the documents. They will need to complete and sign an Affidavit of Service before a JP or lawyer.
- Professional process server: Hobart and Launceston-based process servers typically charge A$120 to A$300, depending on geography and whether the respondent is cooperative.
Joint applications skip this cost entirely.

How to Minimise Costs
File jointly if possible. It eliminates service costs, avoids the need for a process server, and keeps the timeline short.
Check your concession card eligibility early. If you recently became eligible for a Health Care Card through Centrelink, apply for it before filing your divorce application. The card must be valid at the time of filing.
Get the paperwork right the first time. The biggest hidden cost is not the fee itself — it is paying the fee twice because the application was rejected for a procedural error. Common rejection reasons: unwitnessed affidavits, missing concession card scans, and incomplete separation-under-one-roof evidence.
