Every parent in a Delaware divorce, custody, or visitation case involving children under 17 must complete a court-approved Parent Education Class. This isn't a suggestion — it's a mandatory requirement enforced by a hard deadline that can get your entire case dismissed if you miss it.
The 180-Day Dismissal Rule
The moment you file a divorce petition, a 180-day clock starts. If the petitioner doesn't submit a Certificate of Completion for the parent education class within 180 days of the filing date, the court dismisses the petition. No extensions, no exceptions.
In standalone custody and visitation proceedings (not tied to a divorce filing), the consequence is different but equally serious: failure to complete the class can result in case dismissal or an adverse custody decision by the judge.
This is the single most common procedural reason pro se cases fail in Delaware Family Court. Register for a class immediately after filing — don't wait.
What the Class Covers
The required course is a 6-to-8-hour co-parenting education seminar designed to help families navigate the transitions of divorce and separation. It covers:
- How separation and divorce affect children at different ages
- Communication strategies for co-parenting
- Keeping children out of parental conflict
- Building stability during transitions
- Age-appropriate ways to explain changes to children
The class is educational, not therapeutic. It doesn't address your specific custody situation or provide legal advice. Its purpose is to ensure both parents understand the impact of their conflict on their children before the court finalizes any arrangement.
Approved Providers and Cost
Delaware Family Court maintains a directory of approved providers. Classes can be completed in person or online, depending on the provider. The cost is legally capped at $100 per parent by court rule.
Common approved providers include CHILD Inc.'s "Children Cope with Parental Separation" program and certified online portals. The court's parent education FAQ page lists current approved providers — check there rather than relying on a static list, since providers change regularly.

Domestic Violence Exceptions
Parents with a Protection from Abuse (PFA) order or domestic violence convictions have special rules:
- They must attend separate, non-joint classes — not the same session as the other parent
- Class providers are required to accommodate safety concerns during scheduling
- The completion requirement still applies; the exemption is from attending the same session, not from attending at all
How to Apply for Financial Assistance
If the class fee creates a genuine hardship, you can request financial assistance. The process varies by provider — some offer sliding-scale fees, and the court can direct fee waivers through the same In Forma Pauperis provisions used for filing fee waivers. Ask your provider about payment plans or assistance programs when you register.
Online vs In-Person Classes
Both formats satisfy the court requirement, but consider the logistics:
Online classes offer scheduling flexibility and can often be completed in multiple shorter sessions rather than one full day. They're the practical choice for parents with inflexible work schedules or transportation limitations.
In-person classes provide direct interaction with the instructor and other parents going through similar situations. Some parents find the group discussion valuable for processing the emotional aspects of separation.
Either format produces the same Certificate of Completion that you file with the court.
Don't Confuse This With Other Requirements
The parent education class is separate from two other Delaware custody requirements:
- Form 364 (Disclosure Report) — a written filing, not a class
- Mandatory mediation — a court session with a mediator, not an education seminar
All three are required. Completing one doesn't satisfy the others.
