A Delaware divorce involving property division requires a complete financial inventory. You'll need it for the mandatory Form 465 (Ancillary Financial Disclosure Report), for settlement negotiations, and potentially for trial. The more organized you are upfront, the faster and cheaper the process.
Before Filing: Build Your Financial Snapshot
Income Documentation
- [ ] 3 most recent pay stubs for both spouses
- [ ] Last 3 years of federal and Delaware state tax returns
- [ ] W-2s and 1099s for the last 3 years
- [ ] Profit and loss statements (if self-employed)
- [ ] Social Security statements showing estimated benefits
- [ ] Documentation of any other income: rental income, dividends, trust distributions, side business revenue

- [ ] Stock option or RSU grant documentation and vesting schedules
- [ ] Deferred compensation plan details
Real Estate
- [ ] Property deeds and titles
- [ ] Current mortgage statements (including principal balance, interest rate, monthly payment)
- [ ] Home equity line of credit (HELOC) statements
- [ ] Property tax bills (last 2 years)
- [ ] Homeowner's insurance declarations page
- [ ] Recent appraisal or estimated market value (Zillow/Redfin estimates are a starting point; a certified appraisal is needed for court)
Vehicles and Other Property
- [ ] Vehicle titles and registration
- [ ] Current Kelley Blue Book values (include mileage and condition)
- [ ] Outstanding auto loan balances
- [ ] Valuable personal property inventory: jewelry, art, antiques, collectibles, firearms
Debts
- [ ] Credit card statements showing current balances for all cards (joint and individual)
- [ ] Student loan statements
- [ ] Medical debt
- [ ] Outstanding tax obligations (federal, state, local)
- [ ] Personal loans
- [ ] Any other debts: lines of credit, margin loans, family loans
Insurance
- [ ] Health insurance policy details and monthly premium
- [ ] Life insurance policies (term and whole life) with beneficiary designations
- [ ] Disability insurance
- [ ] Long-term care insurance
Monthly Expenses
- [ ] Housing (mortgage/rent, property tax, insurance, maintenance, HOA)
- [ ] Utilities (electric, gas, water, internet, phone)
- [ ] Transportation (car payment, insurance, gas, maintenance)
- [ ] Food (groceries, dining)
- [ ] Healthcare (premiums, copays, prescriptions, dental)
- [ ] Childcare and education
- [ ] Personal expenses (clothing, grooming, gym)
- [ ] Debt payments
After Filing: Critical Deadlines
- [ ] Reserve ancillary matters in your Petition (Form 442) or Answer (Form 448) — failure to do so permanently waives your right to property division and alimony
- [ ] Note the § 1509 automatic injunction effective date — stop all non-routine asset transfers
- [ ] Complete Form 465 within 30 days after the divorce decree is entered (requesting party)
- [ ] File Form 850 (Affidavit of Mailing) with the court after sending Form 465
- [ ] Respond to opposing party's Form 465 within 30 days of receipt
