The standard divorce filing fee in Western Australia is A$1,170 as of July 2026. The divorce filing fee is the big one. For joint applications, only one fee is paid — not double. Payment is by Visa or Mastercard through the eCourts Portal at the time of lodgement.
Do You Qualify for the Reduced A$390 Fee?
The reduced fee is available if you meet specific criteria. For joint applications, both spouses must independently qualify — if only one does, the full A$1,170 applies.
Concession cardholders — you qualify if you hold a current Health Care Card, Pensioner Concession Card, or Commonwealth Seniors Health Card as the primary cardholder.
Government payment recipients — you qualify if you're currently receiving Youth Allowance, Austudy, or Abstudy payments, or if you've been granted Legal Aid funding for the divorce.
Financial hardship — if you don't hold a concession card, you can apply for a reduction by filing Form NP8 through the eCourts Portal. The court assesses three tests:
- Your total liquid assets (cash, bank balances, convertible shares) must not exceed A$4,550
- Your weekly surplus income after basic living expenses must not exceed A$227.50
- Your overall financial position must demonstrate genuine hardship
If you're under 18 or currently serving a prison sentence, you also qualify for the reduced fee.
Secondary Costs to Budget For
Beyond the filing fee, several other expenses commonly arise:
Process server fees (A$100–A$200) — sole applications require formal service on the respondent spouse by an independent third party. You can't serve the papers yourself. A professional process server handles this, especially useful if your spouse is uncooperative or hard to locate.
Document translation (A$50–A$150) — if your marriage certificate is in a language other than English, you need a certified translation from a NAATI-accredited translator, plus a sworn Affidavit of Translation.
Affidavit witnessing (free to A$50) — Justices of the Peace witness documents for free. Practising lawyers or public notaries may charge A$10 to A$50. These are the only authorized witnesses in WA — police officers, teachers, and pharmacists are not accepted unless they also hold a JP commission.
Certified copies and postage — minor costs for serving documents, posting the acknowledgement of service form, and obtaining extra certified copies of your divorce order.

What If You Need Property or Parenting Orders Too?
Divorce only dissolves the legal marriage. It doesn't settle property division, superannuation splitting, spousal maintenance, or parenting arrangements — those are separate applications with their own court fees.
If you and your ex agree on terms, filing consent orders (Form 11) costs A$215. If you can't agree, a contested initiating application runs A$455 to A$740 depending on whether you're seeking financial orders, parenting orders, or both. Defended matters attract additional hearing fees — A$820 per day before a magistrate or A$1,115 per day before a judge.
The critical deadline: you have 12 months from the date your divorce becomes final to file property and maintenance applications. Miss it and you need the court's permission to proceed, which requires exceptional circumstances.
How to Avoid Wasting Your Filing Fee

- Affidavit signed before an unauthorized witness
- Mismatch between the eCourts account email and address for service
- Separation date miscalculated (must be 12 months and one day, not just 12 months)
