Common Mistakes Filing for Divorce in Alberta
The Court of King's Bench has been rejecting desk divorce packages at a high rate. Since September 2025, a pilot program gives clerks a strict three-strike rule: if a clerk finds three errors in your submission, they stop reviewing immediately and reject the entire package. You correct the mistakes, resubmit, and go to the back of the processing queue — adding weeks or months to your timeline.
Here are the most common errors that trigger rejection and how to avoid each one.
Name Mismatches Across Documents
This is the single most frequent rejection trigger. Every document in your desk divorce package must use the exact same spelling of both spouses' names. If your Statement of Claim says "Jonathon Smyth" but your Marriage Certificate says "Jonathan Smith," the clerk will flag it.
How to avoid it: Before filling out any form, check your Marriage Certificate for the exact legal spelling of both names. Use that spelling everywhere — on the Statement of Claim, the Affidavit of Applicant, the Request for Divorce, and the proposed Divorce Judgment. If there is a legitimate name change since the marriage, include a certified copy of the legal name change documentation.
Electronic Signatures on Affidavits
The Affidavit of Applicant (Form FL-23 or FL-24) must have a wet-ink signature — physically signed in pen. Electronic signatures, digital signatures, and typed signatures are not accepted. The affidavit must also be sworn before a Commissioner for Oaths, who signs and stamps the document in person.
How to avoid it: Print the affidavit, sign it in person before a Commissioner for Oaths, and have the Commissioner sign and stamp it at the same time. Many Alberta courthouses have Commissioners available during business hours.
Expired Parenting After Separation Certificates
If your divorce involves children under 18, both parties must complete the Parenting After Separation (PAS) course and file the certificate of completion. The certificate is valid for two years from the date of completion. If it has expired by the day you submit your desk divorce package, the clerk rejects it.
How to avoid it: Check the completion date on your PAS certificate before compiling the desk package. If it will expire before the expected submission date, retake the course. The PAS seminar is free and available online.

Exhibits Not Properly Marked
When you attach the original Marriage Certificate, a Separation Agreement, or other documents as exhibits to the Affidavit of Applicant, the Commissioner for Oaths must stamp and sign the exhibit backing sheet. Loose, unmarked attachments are grounds for immediate rejection.
How to avoid it: Bring all exhibits to your Commissioner appointment. Have each one marked as an exhibit (Exhibit A, Exhibit B, etc.) and stamped before leaving.
Missing the Rule 12.57 Photo
For sole applications, the Affidavit of Service must include a clear photograph of the person who was served (your spouse). Under Rule 12.57, the server must confirm under oath that they used this photo to identify the person they served.
How to avoid it: Before sending your process server out, provide them with a recent, clear photograph of your spouse. Remind them that the photo must be attached to the Affidavit of Service.
Mismatched File Numbers
Every document must reference the correct court file number assigned when you filed the Statement of Claim. Transposing digits or using an old file number from a different action will trigger a flag.
How to avoid it: Keep the stamped copy of your Statement of Claim handy and copy the file number exactly onto every subsequent form.
Incomplete Child Support Documentation
When children are involved, the justice must confirm that adequate child support arrangements are in place before signing the Divorce Judgment. Missing child support worksheets, incomplete Child Support Data Sheets, or child support amounts that do not match the Federal Guidelines will delay or prevent approval.
How to avoid it: Complete the full Child Support Data Sheet for self-represented parties. Use the Federal Child Support Guidelines tables to calculate the correct monthly amount based on the paying parent's gross annual income and the number of children. Include three years of tax returns and Notices of Assessment.
