What the Sworn Financial Statement Requires

The Sworn Financial Statement (Form JDF 1111) is Colorado's mandatory financial disclosure form in every divorce case. Under C.R.C.P. Rule 16.2(e), both spouses must complete and exchange this form within 42 days of service or joint filing. You cannot waive this requirement, even in a fully uncontested case.

JDF 1111 is a multi-page document that captures your complete financial picture: monthly income from all sources, monthly living expenses, assets, debts, and any separate property claims. You sign it under oath, which means inaccurate or incomplete information can result in sanctions, reopened settlements, or contempt findings.

The Supporting Schedules (JDF 1111SS)

The Supporting Schedules form (JDF 1111SS) accompanies JDF 1111 and breaks your assets and debts into detailed categories. This is where you list every account, vehicle, piece of real estate, retirement plan, and liability with current values and ownership details.

The main categories on JDF 1111SS include:

  • Real property — address, fair market value, outstanding mortgage balance, net equity, and whether you claim any portion as separate property
  • Vehicles — year, make, model, fair market value, loan balance
  • Bank and investment accounts — institution, account type, current balance
  • Retirement accounts — 401(k), IRA, pension, deferred compensation plans with current value and marital/separate portions
  • Personal property — furniture, jewelry, electronics, collections
  • Debts — credit cards, medical bills, student loans, personal loans with balances and minimum payments

Every line item needs a current value. Round numbers don't cut it — pull actual statement balances dated as close to your filing as possible.

Required Supporting Documents

Beyond the forms themselves, Rule 16.2(e) requires you to produce a stack of supporting documentation. These must be exchanged along with your completed JDF 1111:

  • Tax returns — the last 3 years of individual and business federal returns, including all schedules
  • Pay stubs — the last 3 months, with additional records if needed for variable or commission income
  • Bank and investment statements — 12 months for all accounts (checking, savings, brokerage, money market)
  • Credit card statements — 3 months
  • Real estate documents — mortgage statements, property tax assessments, and any recent appraisals
  • Insurance policies — life, health, auto, homeowner's declarations pages
  • Retirement plan statements — the most recent annual or quarterly statement for every plan

Missing even one category can trigger a motion to compel and delay your case. Judges take incomplete disclosures seriously.

Common Mistakes That Delay Your Case

Leaving sections blank. Every section of JDF 1111 must be completed. If a category doesn't apply, write "N/A" or "$0" — don't leave it empty. A blank line looks like you're hiding something.

Using outdated values. Asset values should reflect current balances, not what you remember from six months ago. Pull fresh statements before completing the form.

Forgetting to sign under oath. JDF 1111 is a sworn document. Both your signature and the notary block must be completed. An unsigned form will be rejected.

Misclassifying separate property. If you claim an asset as separate property, you need documentation showing it was acquired before the marriage, received as a gift or inheritance, or excluded by a prenuptial agreement. The presumption under Colorado law is that everything acquired during the marriage is marital property — the burden is on you to prove otherwise.

After You File: The Certificate of Compliance

Once you've exchanged all required disclosures, both parties must file a Certificate of Compliance (Form JDF 1104) confirming that the exchange happened. This certificate is due at the Initial Status Conference, which the court generally schedules within 42 days after the court acquires jurisdiction.
