Change Name After Divorce in Northern Territory

Change Name After Divorce in Northern Territory

Changing your name after divorce in the Northern Territory is an administrative process through NT Births, Deaths and Marriages — not a court procedure. You don't need a lawyer, and you don't need court permission. Once you have your final Divorce Certificate, you can revert to your birth name or a previous married name without anyone's consent.

Two Pathways to a Name Change

Option 1: Revert to a Previous Name (Simplest)

If you took your spouse's surname at marriage and want to go back to your birth name or a prior married name, you can use your Divorce Certificate as evidence of the name change. Many organisations accept the certificate alone — no formal application to Births, Deaths and Marriages required.

You simply present the certificate (showing your married name) alongside your birth certificate (showing your previous name) to each organisation and request the update.

Option 2: Formal Name Change Application

If you want a completely new name (not your birth name or a prior surname), you need to apply through the NT Registry of Births, Deaths and Marriages for a formal Change of Name Certificate. This requires:

  • A completed application form
  • Your final Divorce Certificate
  • Proof of identity (100-point ID check)
  • Payment of the registry fee

The fee varies — check the current NT BDM schedule. Processing takes approximately 2–4 weeks.

Updating Your Records After the Name Change

Once you have either your Divorce Certificate (for reverting) or your Change of Name Certificate (for a new name), work through this list:

Government agencies first:

  • Medicare card
  • Centrelink / Services Australia
  • Australian Taxation Office (notify via myGov)
  • Australian Electoral Commission
  • NT driver's licence (MVR)
  • Australian passport (apply for replacement)

Financial institutions:

  • Bank accounts (present certificate + photo ID at branch)
  • Superannuation fund(s)
  • Insurance policies (car, home, health, life)
  • Credit cards

Employment and education:

  • Employer payroll and HR records
  • Professional registration boards
  • University/TAFE records (for academic transcript reissue)

Other:

  • Property titles (if relevant — through NT Land Titles Office)
  • Utilities and internet providers
  • Vehicle registration
  • Electoral roll

Tips for an Efficient Name Change

Do government agencies first — once Medicare and the ATO have your new name, other organisations often accept those as supporting evidence.

Batch the bank visits — bring your certificate, photo ID, and account details. Most banks can update across all your products in one appointment.

Passport takes longest — the Australian Passport Office requires the original or certified copy of your name change evidence and current passport. Processing is 6–8 weeks. If you have imminent travel, apply early or consider an urgent processing fee.

Update your will — even if the provisions naming your former spouse were voided by the divorce, an updated will with your correct current name prevents confusion for your executor.

What If Your Children's Name Should Change?

Changing a child's surname after divorce is a separate process and typically requires both parents' consent (or a court order if one parent objects). This is handled through NT BDM as a separate application with additional consent requirements under the Births, Deaths and Marriages Registration Act.

The Northern Territory Divorce Filing Process Guide includes a post-divorce administration checklist with every agency notification needed — organised by priority so your identity transition is completed efficiently.
